By accessing or using Ala Kaam, you agree to these Terms of Service. If you are a Seller, you will also be asked to separately accept our Seller Agreement when you set up a store.
Welcome to Ala Kaam. These Terms of Service ("Terms") govern your access to and use of the Ala Kaam website, mobile applications, and related services (collectively, the "Platform").
By accessing, browsing, creating an account, listing products, contacting sellers, or otherwise using the Platform, you agree to be legally bound by these Terms, our Privacy Policy, and all other applicable Ala Kaam policies referenced herein. If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Ala Kaam.
Ala Kaam is a marketplace and discovery platform only. Ala Kaam allows Sellers to create stores and display products, and allows Buyers to browse listings and contact Sellers directly.
Ala Kaam does not:
All communication, negotiation, payment, delivery, returns, refunds, warranties, and disputes occur directly between the Buyer and the Seller, outside of Ala Kaam's control.
Ala Kaam is not a party to any transaction between Buyers and Sellers.
Nothing in these Terms creates any partnership, joint venture, agency, employment, franchise, brokerage, fiduciary, or representative relationship between Ala Kaam and any User.
Sellers are independent parties and are not employees, agents, representatives, or partners of Ala Kaam.
Sellers are solely responsible for their stores, listings, products, and transactions.

Buyers are solely responsible for evaluating Sellers and Listings before making any purchase or payment.
Buyers should independently verify:
Ala Kaam is not responsible for any loss arising from a Buyer's decision to transact with a Seller.
Sellers may create Listings and upload Content to the Platform. You are solely responsible for any Content you submit.

Ala Kaam Property
The Ala Kaam name, logo, design, software, and Platform content are owned by Ala Kaam or its licensors and are protected by intellectual property laws.
User Content
You retain ownership of the Content you submit. By submitting Content, you grant Ala Kaam a worldwide, non-exclusive, royalty-free license to use, display, reproduce, distribute, modify, and promote that Content in connection with operating and marketing the Platform.
Ala Kaam respects intellectual property rights. If you believe that any Listing or Content infringes your copyright or trademark, you may submit a notice to Ala Kaam. Ala Kaam may remove allegedly infringing Content and may terminate repeat infringers.
Ala Kaam has no obligation to monitor Listings, Content, messages, transactions, or User conduct. We may, but are not required to, review, remove, or investigate any Content or activity. Failure to remove or investigate any Content does not constitute approval, endorsement, or responsibility.
Ala Kaam reserves the right to refuse service to anyone, remove any Listing, suspend or terminate any account, and restrict access to the Platform at any time, with or without notice, for any lawful reason.
By posting Content on the Platform, you grant Ala Kaam a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, adapt, publish, and promote such Content for the operation, improvement, and marketing of the Platform.
The Platform may use or link to third-party services, including but not limited to hosting providers, analytics services, authentication providers, communication tools, maps, and cloud services. Ala Kaam is not responsible for the availability, accuracy, security, or practices of third-party services.
Ala Kaam may introduce additional features in the future, including payment processing, commissions, subscriptions, advertising, premium listings, AI features, mobile applications, or other services. Such features may be subject to additional terms, which will become binding when the feature is used.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALA KAAM DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALA KAAM, ITS OWNERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
This includes, without limitation:
Ala Kaam's total aggregate liability for any claim arising out of or relating to the Platform or these Terms shall not exceed the greater of PKR 1,000, or the amount, if any, paid by you directly to Ala Kaam in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Ala Kaam, its owners, directors, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, judgments, penalties, costs, and expenses (including reasonable legal fees) arising from or related to:
You voluntarily assume all risks associated with using the Platform, communicating with other Users, and entering into transactions with Sellers or Buyers.
Ala Kaam does not guarantee that data, messages, Listings, images, or account information will always be available, secure, or recoverable. You are responsible for maintaining your own backups of important information.
Ala Kaam may modify, suspend, restrict, or discontinue any part of the Platform at any time, with or without notice. Ala Kaam shall not be liable for any unavailability, interruption, delay, or discontinuation of the Platform.
By using the Platform, you consent to receive electronic communications from Ala Kaam, including notices, updates, policy changes, and account-related messages.
Ala Kaam may update these Terms at any time by posting the revised version on the Platform. The updated Terms will become effective on the date indicated by the "Last Updated" notice. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
Ala Kaam may suspend or terminate your account or access to the Platform at any time, with or without notice, for any lawful reason. Upon termination, your right to use the Platform will cease immediately.
The following provisions shall survive termination of these Terms:
No failure or delay by Ala Kaam in enforcing any provision of these Terms shall constitute a waiver of that provision or any other provision.
Ala Kaam may assign or transfer these Terms, in whole or in part, without notice. You may not assign or transfer your rights or obligations under these Terms without Ala Kaam's prior written consent.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Ala Kaam shall not be liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, internet outages, power failures, government actions, strikes, cyberattacks, or other force majeure events.
These Terms, together with the Privacy Policy and any other applicable Ala Kaam policies, constitute the entire agreement between you and Ala Kaam regarding the Platform and supersede all prior communications and agreements.
These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Lahore, Punjab, Pakistan.
