This Seller Agreement applies specifically to anyone who creates a store or lists products on Ala Kaam, in addition to our general Terms of Service and Privacy Policy.
This Seller Agreement ("Agreement") governs the relationship between Ala Kaam ("Ala Kaam," "we," "our," or "us") and any individual or business that creates a Seller account, opens a store, lists products, or otherwise sells through the Ala Kaam Platform ("Seller," "you," or "your").
This Agreement supplements our Terms of Service and Privacy Policy. By registering as a Seller, creating a store, publishing Listings, or otherwise using Seller features, you agree to be legally bound by this Agreement.
If there is any conflict between this Agreement and the Terms of Service regarding Seller responsibilities, this Agreement shall govern to the extent of that conflict.
To become a Seller, you represent and warrant that:
Ala Kaam may require identity verification or additional information at any time.
Each Seller is responsible for maintaining the confidentiality and security of their account. You agree that:
Ala Kaam reserves the right to suspend, restrict, or terminate any Seller account at its sole discretion for any lawful reason.
Ala Kaam permits Sellers to create online storefronts for displaying products and business information. Your store may include:
You are solely responsible for all content displayed in your store.
Ala Kaam provides only a platform through which Buyers and Sellers may discover one another. Unless and until Ala Kaam expressly introduces payment processing services:
All agreements relating to payment, delivery, warranties, returns, exchanges, and refunds exist solely between the Buyer and Seller.
As a Seller, you are solely responsible for every aspect of your business conducted through Ala Kaam. This includes, without limitation:
Ala Kaam assumes no responsibility for your business operations.
You are solely responsible for every Listing you publish. Each Listing must:
Ala Kaam may edit, remove, reject, suspend, or permanently delete any Listing at any time, with or without notice.
By listing a product, you represent and warrant that you own the product, or you have the legal authority to sell the product. You further warrant that the sale of the product does not violate:
You represent and warrant that every Listing accurately describes the product offered. You shall not falsely claim that a product is:
unless such claims are truthful and can be substantiated if requested.
Counterfeit goods are strictly prohibited. You agree that you will not list or sell products that infringe the intellectual property rights of others. This includes:
Ala Kaam may immediately remove such Listings and terminate your Seller account.
You represent and warrant that every product listed:
You are solely responsible for injuries, damages, recalls, or legal claims relating to your products.
You agree to comply with all applicable laws and regulations, including those relating to:
You are solely responsible for determining which laws apply to your business.
You are solely responsible for:
Ala Kaam does not calculate, collect, report, or remit taxes on your behalf unless expressly stated in writing for a future feature.
You are solely responsible for:
Ala Kaam is not responsible for pricing errors.
You are responsible for maintaining accurate inventory. You agree not to knowingly list products that:
Repeated inaccurate inventory may result in account suspension.
You represent and warrant that you own the rights to every image you upload, or you possess sufficient legal rights or permission to use each image. You shall not upload:
By uploading images, you grant Ala Kaam a worldwide, royalty-free, non-exclusive license to display, reproduce, resize, promote, and distribute those images solely for operating, improving, and marketing the Platform.
All product descriptions must be truthful, accurate, and complete. You shall not:
You agree to communicate with Buyers in a professional, respectful, and lawful manner. You shall not:
You retain ownership of the intellectual property rights in the content you upload. However, by uploading content, you grant Ala Kaam a worldwide, perpetual, royalty-free, non-exclusive license to display, publish, reproduce, resize, translate, promote, market, and distribute your store, Listings, photographs, videos, logos, and descriptions in connection with operating and promoting the Platform.
Ala Kaam may, at its sole discretion and without prior notice:
Ala Kaam has no obligation to explain its decisions.
Unless Ala Kaam expressly introduces integrated shipping services in the future, Sellers are solely responsible for:
Ala Kaam is not responsible for shipping services, delivery failures, delays, lost packages, damaged goods, customs issues, or carrier performance.
The Seller is solely responsible for establishing and honoring any policies relating to:
Unless Ala Kaam expressly introduces Buyer Protection or Payment Services in the future, Ala Kaam does not guarantee refunds, process refunds, resolve refund disputes, guarantee exchanges, or enforce warranties. All such matters remain exclusively between Buyers and Sellers.
The Seller agrees to respond to Buyer inquiries in a timely, professional, and respectful manner. The Seller is solely responsible for:
Ala Kaam has no obligation to provide customer service relating to Seller products.
Buyers may submit reviews or ratings regarding Sellers and Listings. Sellers agree that:
Attempting to manipulate reviews through fake accounts, incentives, intimidation, or other deceptive practices may result in suspension or termination.
Ala Kaam makes no guarantee regarding:
Creating a Seller account does not create any expectation or guarantee of income.
Search results may be determined using a variety of factors, including relevance, product information, user preferences, platform quality signals, and other criteria chosen by Ala Kaam. Ala Kaam may modify search algorithms at any time without notice.
Sellers have no contractual right to a particular search position or level of visibility.
Sellers shall conduct business honestly, fairly, and professionally. Sellers shall not:

These representations remain true throughout the Seller's use of the Platform.
To the fullest extent permitted by applicable law, the Seller agrees to defend, indemnify, and hold harmless Ala Kaam, its owners, directors, officers, employees, contractors, affiliates, successors, and agents from and against any claims, actions, demands, liabilities, losses, damages, judgments, fines, penalties, settlements, costs, and expenses (including reasonable legal fees) arising out of or relating to:
This obligation survives termination of the Seller's account.
To the fullest extent permitted by applicable law, Ala Kaam shall not be liable for:
Ala Kaam's total liability arising from this Agreement shall not exceed the greater of PKR 1,000, or the amount paid directly by the Seller to Ala Kaam during the previous twelve (12) months.
Although Ala Kaam has no obligation to monitor Sellers, Ala Kaam may, at its sole discretion:
Failure by Ala Kaam to investigate any matter shall not constitute approval of any Seller's conduct.
Ala Kaam may introduce additional Seller features in the future, including:
Such features may be governed by additional agreements that become effective when those services are used.
Ala Kaam may suspend, restrict, or terminate a Seller account immediately, with or without notice, for any lawful reason, including suspected violations of this Agreement, the Terms of Service, applicable law, intellectual property rights, or Platform policies.
Termination may include removal of Listings, store pages, images, reviews (where appropriate), and Seller content.
Termination does not relieve the Seller of obligations that accrued before termination.
The following provisions survive termination of this Agreement:
Ala Kaam shall not be liable for delays or failures resulting from events beyond its reasonable control, including:
Ala Kaam may assign or transfer this Agreement, in whole or in part, without notice. The Seller may not assign this Agreement or any rights or obligations under it without Ala Kaam's prior written consent.
This Seller Agreement, together with the Terms of Service, Privacy Policy, Acceptable Use Policy, Community Guidelines, Copyright & Intellectual Property Policy, Prohibited Items Policy, Cookie Policy, and any other applicable Ala Kaam policies, constitutes the entire agreement between Ala Kaam and the Seller regarding the Seller's use of the Platform.
This Agreement shall be governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Lahore, Punjab, Pakistan.
